1. General
1.1. These terms and conditions (“Terms”) apply to all orders and purchases made through the website Fancy the Pancy (the “Website”), owned and operated by Fancy the Pancy B.V., located in Zeist, The Netherlands, registered under the Dutch Chamber of Commerce number 93424272.
1.2. By placing an order on our Website, you agree to be bound by these Terms. If you do not agree with any part of the Terms, please do not use our Website.
1.3. These Terms are governed by Dutch law. Any disputes arising from these Terms shall be submitted to the competent court in accordance with applicable laws and consumer protection regulations.

2. Products and Pricing

2.1. Fancy the Pancy B.V. operates as a reseller and does not manufacture the products it sells. We source products from trusted suppliers.
2.2. All prices are listed in Euro and include Value Added Tax (VAT) unless otherwise specified. Prices are subject to change without prior notice.
2.3. Fancy the Pancy B.V. is not liable for errors in product descriptions, specifications, or pricing, though we strive for accuracy.
2.4. While we make every effort to ensure accurate pricing, obvious pricing errors or technical mistakes may occasionally occur. If an order is placed based on a clear and unmistakable error, we reserve the right to cancel the order and issue a full refund.

3. Orders and Payments
3.1. Orders are subject to acceptance and availability. Fancy the Pancy B.V. reserves the right to refuse or cancel any order for any reason, including stock limitations or errors in pricing.
3.2. Payment is required at the time of placing the order. Accepted payment methods are listed on the Website. Fancy the Pancy B.V. uses secure payment systems and does not store payment details.

4. Shipping, Delivery, and Return of Undelivered Items
4.1. Fancy the Pancy B.V. ships worldwide unless otherwise specified. Shipping fees and estimated delivery times are provided during checkout.4.2.Orders placed before 15:00 are typically dispatched the same business day. During peak periods, holidays, or unforeseen circumstances, dispatch may take longer. Delivery times are estimates and may vary depending on the carrier and destination.

4.3. If the recipient is not available, the package may be delivered to a neighbor or parcel shop. The customer is responsible for collecting the package. If uncollected within 7 days, the package may be returned to Fancy the Pancy B.V. The customer may incur additional shipping charges for redelivery or receive a refund minus return fees.

4.4.Fancy the Pancy offers complimentary gift wrapping on most products. While every effort is made to present each gift beautifully, wrapping styles, ribbons, and packaging materials may vary depending on availability and season.

4.5. If your order arrives damaged or incomplete, please contact us as soon as possible at hello@fancythepancy.com. We will make reasonable efforts to resolve the issue promptly.

5. Right of Withdrawal and Non-Returnable Products
5.1. In accordance with Dutch consumer law, consumers have a right of withdrawal and may return their purchase within 14 days of receiving the product without providing a reason.
5.2. To exercise this right, notify us via hello@fancythepancy.com within 14 days of receiving the product. The product must be returned in its original condition and packaging.
5.3. Customers are responsible for return shipping costs unless the product was damaged or defective upon arrival. Refunds will be processed within 14 days of receipt, excluding initial shipping costs.
5.4. Exceptions: The right of withdrawal does not apply to custom-made items, perishable goods, sealed items that cannot be returned for hygiene reasons if unsealed, and time-sensitive items.

6. Warranty and Liability
6.1. Under Dutch consumer law, Fancy the Pancy B.V. provides a warranty that products shall conform to reasonable consumer expectations. This includes coverage for defects present at the time of delivery.
6.2. If a product does not meet these expectations, please contact us at hello@fancythepancy.com. Depending on the situation, we may offer a replacement, repair, or refund.
6.3. Nothing in these Terms shall limit or exclude any rights that consumers may have under applicable law. Fancy the Pancy B.V. shall not be liable for indirect or consequential damages arising from the use of the Website or products, except where such liability cannot be excluded under applicable law.
6.4. Customers outside the Netherlands acknowledge that Fancy the Pancy B.V. only ensures compliance with Dutch laws and regulations, and is not responsible for compliance with laws in other countries.

7. Ownership and Risk
7.1. Ownership of products remains with Fancy the Pancy B.V. until full payment has been received. Risk transfers to the customer upon delivery.
7.2. Customers may not resell or dispose of products until full payment has been received. If products are sold before payment, Fancy the Pancy B.V. reserves the right to reclaim the sales proceeds.

8. Intellectual Property
8.1. All content on the Website, including text, images, logos, and trademarks, is the property of Fancy the Pancy B.V. or its licensors and is protected by intellectual property laws.
8.2. You may not use, reproduce, or distribute any content from the Website without the express written permission of Fancy the Pancy B.V.

10. Complaints and Dispute Resolution
10.1. If you have any complaints, please contact us at hello@fancythepancy.com. We will work to resolve your complaint within a reasonable time.
10.2. If unresolved, you may submit the dispute to the competent court in Utrecht, The Netherlands.

11. Promotions and Special Offers
11.1. Promotional offers, discounts, and coupons must be used as specified and apply to a single order only. They cannot be combined or redeemed retroactively.
11.2. In cases where a promotion applies to an order that is partially returned, Fancy the Pancy B.V. reserves the right to adjust the refund amount. For example, if a promotional discount required the purchase of multiple items and one is returned, the refund will be calculated based on the remaining items.

12. Changes to Terms
12.1. Fancy the Pancy B.V. reserves the right to modify these Terms at any time. Updated terms will be posted on the Website and apply immediately.
12.2. Continued use of the Website after changes have been posted constitutes acceptance of the revised Terms.
